Arbitration Rules

AMTAC primarily administers arbitration cases in accordance with the AMTAC Arbitration Rules 2016, which came into effect on 1 July 2016. These Rules supersede the earlier edition of the AMTAC Rules. If the parties have specifically agreed to the application of the earlier edition of the AMTAC Rules, AMTAC will administer the arbitration under those rules.

Rocket Docket Procedure

AMTAC also offers a AMTAC Rocket Docket procedure which may be suitable for less complex and lower value claims. The Rocket Docket procedure, when agreed to by the parties, has the following features:

  • One arbitrator
  • No hearing(s)
  • On documents only
  • Statement of defence provided within 21 days
  • AUD4,000 (exclusive of GST) arbitrator’s fee
  • AUD1,000 (exclusive of GST) registration fee
  • Final award within 3 months of the commencement of the arbitration proceeding.

The AMTAC Arbitration Rules will apply to a AMTAC Rocket Docket arbitration subject to the above features. Where there is any conflict or inconsistency between the AMTAC Arbitration Rules and the Rocket Docket features, the Rocket Docket features will apply.

AMTAC recommends that the AMTAC Rocket Docket only be used for a dispute involving claims not greater than AUD100,000.

The AMTAC Rocket Docket must be agreed to by each party. This can be stated to in the arbitration agreement or can be agreed after the dispute has arisen.
